MY WIFE WAS CAUGHT AT THE BORDER WITH FALSE PAPERS OVER 5 YEARS AGO DO YOU THINK SHE CAN GET A WAIVER?

maybe would be the right answer. When she was refused entry, was she given some sort of ineligibility? Sometimes that happens, but not always. If she came in with someone else's US passport or with one that was altered, then you have real problems, as there is no waiver for that. Otherwise, if she actually has some sort of eligibility related to this, she will at least be able to apply for a waiver, and possibly get it, assuming of course you've filed an immigrant visa petition for her. Does she have the correct papers to get in now? Obviously she did not have them 5 years ago or she would have used them. If she has the correct paperwork then she can apply for the waiver but it is about a 50-50 shot. At least you'll know. Assuming she was caught when entering the U.S., the applicable U.S. federal laws basically say that:


* INA 212(a)(6)(C)(i): She is indefinitely inadmissible into the U.S.


* INA 212(a)(6)(C)(iii): A waiver for the above violation is possible as specified in INA 212(i) (see next two points).


* INA 212(i)(1): A waiver is may be granted by authority of the Attorney General (in practice this usually means by USCIS) if any of you or your wife's parents are U.S. citizens or lawful permanent residents or if she is a self-petitioning victim under the Violence Against Women Act, and that she can prove that her exclusion from the U.S. creates ';extreme hardship'; to your family. The law does not define ';extreme hardship';.


* INA 212(i)(2): If the waiver above is granted or denied by USCIS, the decision cannot be overturned by an immigration judge, so there is one chance only, and no appeal.



Border police are not very forgiving. My friend's mom (who is born and raised Canadian) is blacklisted because she once had a gold chain (she forgot to claim) in her glove compartment when driving from the US to Canada. She ALWAYS gets pulled aside and searched because they put a mark on her file.





It''s not very smart to try to trick Border officers.
Why would we give her a waiver when she has already proven how unworthy she is. Even if it was 5 yrs ago that doesn't change the fact that she is an unsuccessful con and has not business in our great country. I wouldn't let that women mow my lawn. The truth hurts especially to flagots.
I don't think that at this moment she could get a waiver. Because of the amount of illegals coming into the USA, the government is getting tougher with illegals and I think that is going to get tougher. If she gets caught again she will go to jail and then get deported.
It never hurts to try and do the right thing. Go through the process and be willing to suffer the consequences.





You never know. You may be surprised at the outcome.






I would hope not, you say she was caught with false papers. I would expect that she be permanently banned from entering this country.
No, they are really much more strict now than ever. Since 911 they will not allow someone who has done something illegal into the states.
I would think not, unless you got a very, very, very good lawyer to help get her through the process.
